What are Trade Marks
In most countries trade mark registration is granted by the Government. Registration effectively conveys a monopoly to the owner of the registered mark to use that mark on the goods and/or services of interest.
Registering a Trade Mark
We help our clients with Trade Mark registraiton. Applications for registration are filed at the appropriate government department, in the UK the Trade Marks Registry within the Patent Office. The basic information required is the name and address of the trade mark owner, the goods or services for which registration is sought and, of course, copies of the trade mark itself.
Renewing a Trade Mark
Renewing a Trade Mark is very important and a key service we provide. If the application meets the relevant legislative requirements, registration is granted, in most cases for ten years, renewable for further periods of ten years indefinitely.
International Trade Marks
As a rule trade mark registration is country specific and separate applications have to be made for each country of interest. In recent years however it has become possible to register trade marks for specific groups of countries by means of one application. The two main organisations which provide this facility are:
The Community Trade Mark Registry (CTM)
This allows for one registration covering all of the EU countries
The Madrid Protocol (MP)
A group of around 60 countries forming an organisation which permits registration entailing one registration covering any of the countries within the organisation. If you or your company trades on an international basis then the above options are very attractive both in terms of economy and in administrative simplicity.
